A Personal Thank You

it is time for me to step away, but I want to clarify some things and thank some people before I go. I know some of you are aware that I stepped back in at SEJ?temporarily in December. Neither I or the company that owns SEJ, Alpha Brand Media, planned on me staying on long-term. We have worked together to find the best new editor we could for SEJ and we are thankful we found John.

I have always enjoyed the SEJ community and working one-on-one with the writers that contribute to SEJ. I want to thank all the people that have supported me as editor when I came to SEJ in October 2011. You made my work even more fun than it already was.

AB 1152: keeping Cal-SAFE safe - California's Children

NinaFebruary 27, 2013: "It is one thing for a school board to think about which of the K-12 programs are most important to the K-12 students in their district, and decide priorities.?It is quite another to pit two different groups of children (K-12 students and young children of teen parents) against each other for funding." -- Nina Buthee, at left, executive director of the??California Child Development Administrators Association?(CCDAA).

CCDAA is sponsoring AB 1152, a bill authored by Assemblymember Tom Ammiano (D-San Francisco), that would exempt?California School Age Families Education (Cal-SAFE) Program from categorical "flexing" -- protecting funding for programs for teen parents from proposed changes to categorical programs. If passed, the bill will also require that unused Cal-SAFE funds not be retained by local education agencies (LEAs), but be returned to Cal-SAFE's state-wide budget line.?

The Cal-SAFE program, begun in 2000, works with teenaged parents, providing academic and support services to help keep them in school. According to TeenNow?California, Cal-SAFE's in-school program has had a 75% graduation rate (compared to a national graduate rate of 33% for teen parents.)?

In an e-mail to California's Children, CCDAA's Buthee said:?

Buthee added, "Most of the categoricals serve K-12 students (Miller-Unruh reading program, text book funding, home to school transportation, etc., etc.).? CalSAFE?s child development dollars are targeted at a different group of children ? the children of teen parents...

"Education for K-12 students is mandated by the state Constitution, and local boards cannot eliminate education for any of those students ? they must spend the money on those students, it is just how to spend the money on them.? There is no mandate to serve the young children of teen parents.? What happens when there is budget pressure, including the pressure of negotiations with unions?? One group the board must serve, the other it can eliminate."

CCDAA is seeking additional co-authors.

Francis Crick's Nobel Prize medal to be auctioned

Sixty years after the discovery of DNA's spiraling, ladder-like structure first hinted at the mechanism by which life copies itself, one of the Nobel Prize medals honoring this achievement is up for sale.

Three men who played crucial roles in deciphering?DNA's double helix?in 1953 later received the?Nobel Prize in Physiology or Medicine. The family of one of those men, Francis Crick, plans to sell his medal, the accompanying diploma and other items at auction with a portion of the proceeds set to benefit research institutions in the United States and the United Kingdom.

"It had been tucked away for so long," said Kindra Crick, Francis Crick's 36-year-old granddaughter, of the medal. "We really were interested in finding someone who could look after it, and possibly put it on display so it could inspire the next generation of scientists." Francis Crick passed away?in 2004 at the age of 88.?

The value of Nobel gold

There is little precedent for this sale. Nobel medals appear to have changed hands publicly in only a couple of instances. This particular medal, like others made before 1980, is struck in 23-carat gold, and recognizes a particularly high-profile accomplishment in biology, one fundamental to?modern genetics.

The auction house handling the sale, Heritage Auctions, has valued the medal and diploma at $500,000, which is "an educated guestimate," said Sandra Palomino, Heritage Auctions' director of historical manuscripts. Estimates by Heritage's in-house coin experts went as high as $5 million, Palomino said. [See Photos of Crick's Medal & Other Auction Items]

The April auction will also include Crick's award check with his endorsement on the back, the scientist's lab coat, his gardening logs, nautical journals and books. Separately, the family hopes to sell a letter Crick wrote in 1953 to his then-12-year-old son Michael, who is Kindra's father, describing the discovery's meaning. The auction house Christies, which Kindra Crick said is handling the sale, declined to confirm plans to sell this letter.

Out of the box

The medal was not displayed much within Crick's family. Kindra remembers that the Nobel, which she has yet to see herself, was locked in a room with her grandfather's other awards and other family heirlooms after he moved to California at the age of 60. After the scientist's wife, Odile, passed away in 2007, the medal was sequestered in a safe deposit box. Crick's children, including Kindra's father, Michael, attended the award ceremony in 1962, but saw almost nothing of the medal afterward.

Kindra plans to get a look at the medal before the auction.

"My grandfather was not the type of personality to show off," she said. "His conversation tended to be on what's next as opposed to reminiscing about the past ? I guess he always thought there was more to come."

Crick's family hopes to see the medal displayed publicly after its sale; however, Kindra Crick acknowledged that a public auction offered no guarantee a buyer would display the award. But she is optimistic, saying those individuals or institutions with enough interest in science to bid on the medal are also likely to display it publicly. Crick's family and Heritage Auctions plan to donate a portion of the proceeds from the sale of the medal and the other items to The Francis Crick Institute, a medical research institute scheduled to open in London in 2015. A portion of the proceeds from the sale of the letter will go to benefit the Salk Institute in California, where Francis Crick studied?consciousness?later in his career, Kindra said.

Sixty years later

On Feb. 28, 1953, according to legend, Crick and his colleague James Watson announced that they had discovered the "secret of life" in a pub frequented by other Cambridge University scientists.

This followed Watson's realization that the molecular bonds between the two types of base pairs in DNA ? adenine with thymine and cytosine with guanine ? were identical in shape, suggesting a double helix with complementary halves, Watson recounts in "The Annotated and Illustrated Double Helix" (Simon & Schuster, 2012).

This discovery was the result of a combination of approaches; Watson and Crick built models, trying to determine how the molecules known to make up DNA (deoxyribonucleic acid) fit together. Meanwhile, two of their colleagues, Maurice Wilkins and Rosalind Franklin, created images by bouncing X-rays off DNA crystals.

One of Franklin's images,?called Photograph 51, provided key evidence of a helical shape.

Crick, Watson and Wilkins received the Nobel Prize in 1962. Franklin did not because she passed away in 1958, and the Nobel Prize is not awarded posthumously.

Form means function

In the years prior to this discovery, scientists knew of the existence of DNA (a type of molecule known as a nucleic acid), but not what it looked like or its true function. They also knew genes carried traits from generation to generation, but many scientists believed genes to be made of proteins, said Jan Witkowski, executive director of the Banbury Center at Cold Spring Harbor Laboratory in New York.

The discovery of the structure of DNA was key to understanding the molecule's function as the code for genes. Watson and Crick understood this, but when they described their discovery in a paper in the journal Nature in April 1953, they wrote coyly of the implications: "It has not escaped our notice that the specific pairing we have postulated immediately suggests a possible copying mechanism for genetic material." However, in the letter to 12-year-old Michael, dated March 19, 1953, Crick drew a diagram spelling out the scientists' theory of how DNA replicated: the double helix and its base-pair rungs separated to create templates for new strands.

"In other words, we think we have found the basic copying mechanism by which life comes from life," Crick wrote to his son. The scientists signed the letter, which appears in "The Annotated and Illustrated Double Helix," "lots of love, Daddy."

A geneticist himself, Witkowski lists the discovery of the structure of DNA as one of the three most pivotal accomplishments in biology, along with Charles Darwin's theory of evolution by natural selection and?Gregor Mendel's principles of inheritance. ?

"Of course, it wasn't so much what each discovery was in itself, but what avenues it opened up and what it led on to," said Witkowski, who with Alexander Gann, edited the "Annotated and Illustrated Double Helix."

'Sequester' in US skies: Is an FAA 'calamity' avoidable?

Transportation Secretary Ray LaHood says the 'sequester' will force the FAA to furlough air traffic controllers, creating an air travel nightmare. Some Republicans are calling this a scare tactic.

The federal budget ?sequester,? Transportation Secretary Ray LaHood said Friday, would be a ?calamity? that would force the Federal Aviation Administration to reduce hours at hundreds of control towers and airports and completely close dozens more, leading to gridlock in the skies and long delays and cancellations in the nation?s airports.

As part of the $85 billion across-the-board spending cuts known as the sequester, the Department of Transportation must cut $1 billion from its annual budget, of which about $600 million would be slashed from the FAA, which oversees air travel. According to Secretary LaHood, that translates into furloughs for most of the agency?s 47,000 employees and closures of more than 100 air traffic control towers across the country ? a situation LaHood, in a series of appearances over the weekend, said would be ?very painful for the flying public.?

?It is going to be chaos for air travelers,? says Henry Harteveldt, a travel-industry analyst with advisory firm Hudson Crossing. ?Hundreds of control towers are slated to have either hours reduced or eliminated altogether. This is big.??

And while the projected disruption to air travel is deeply concerning to many, the ?sky-is-falling? scenario has some analysts skeptical about the administration?s use of the cutbacks in air transportation as a political football. After all, air travel delays are a popular weapon in the political debate because they impact so many Americans in a particularly irritating fashion.

?There may be some actions being done to create drama where there doesn?t need to be,? says Mr. Harteveldt. ?It can be as bad as the FAA and TSA want to make it.?

To what extent, then, is the dismal picture painted by LaHood fear-mongering designed to pressure lawmakers to reach a budget deal? Can the FAA target cuts in other areas to mitigate the impact for travelers, or are LaHood?s hands tied?

Congressional Republicans have accused the administration of using the air traffic control cuts to ?create alarm.?

?Before jumping to the conclusion that furloughs must be implemented, the administration and the agency need to sharpen their pencils and consider all the options,? Sen. John Thune (R) and Reps. Bill Schuster (R) and Frank LoBiondo (R), said in a joint statement Friday.

According to?Politico, the group said there were other areas in which the FAA could instead cut ?fat,? like the more than $500 million spent each year on consultants, or the $200 million spent on supplies and travel.

LaHood has countered the claims, saying he has no choice but to reduce air-traffic staffing.

?The largest number of employees at DOT is at FAA, of which the largest number are FAA controllers," LaHood said Sunday on CNN?s ?State of the Union.? "We are going to try and cut as much as we possibly can out of contracts and other things that we do. But in the end, there has to be some kind of furlough of air traffic control.?

Michael Boyd, an aviation analyst with Boyd Group International, an aviation consulting and forecasting firm, says the move is ?engineered to be as difficult as possible for the consumer.?

?Ray LaHood and his group will make it as hard as possible. They?re going to want to take this right to the consumer and make the consumer feel as much pain as possible,? says Mr. Boyd. ?This is how you make a point.? This is frankly a political program.?

What?s more, says Harteveldt, cuts could be focused on less critical areas to lessen the impact for travelers.

?I?m sure there are options available to them that would be considered discretionary ? less important, less strategic areas ? that could be examined and cut [without] ? affecting frontline service and frontline personnel,? he says.

Among the options cited by Harteveldt and Boyd are reducing spending on private contractors, management, and support staff, as well as temporarily suspending discretionary projects like personnel training and next-generation air traffic control systems.

?There is a concentrated effort to tell everyone how bad it will be,? says Boyd. ?It doesn?t have to be.?

Scott Lilly, a senior fellow at the Center for American Progress, disagrees. Not only are LaHood?s options limited under the law, he says, ?it could be even worse.?

?It?s surprising to a lot of people, but the truth is these budgets don?t work the way you think they do,? says Mr. Lilly, who worked in Congress for more than three decades, including as staff director of the House Appropriations Committee. ?There is a lot less latitude than you might suppose.?

The 1985 Gramm-Rudman Act, which originally introduced the concept of automatic spending cuts, as well as the Budget Control Act of 2011, which introduced this sequester, stipulate how government programs must be cut if voluntary spending reductions are not agreed on. The legislation, says Lilly, mandates formulaic across-the-board cuts of approximately?5.3 percent?on all non-national security government programs, with some exceptions. That means the FAA must shoulder an equal percentage of the financial burden as other government agencies.

?The problem with programs like the FAA is that they?re almost all salaries,? he adds, explaining that much of the budget is devoted to air traffic controllers? salaries and control towers that are leased under fixed contracts.

What?s more, the FAA will have spent half of its budget for the fiscal year by March 30, when cuts would likely go into effect, which means the agency would have to enact even steeper cuts to achieve the necessary reductions over a shorter period of time.

As such, says Lilly, LaHood?s hands are effectively tied.

?There?s not a lot of flexibility,? he says. ?My view is that this may be even worse for the FAA than what LaHood has described.?

Members of 1st U.S team to top Everest reunite

BERKELEY, Calif. (AP) ? It might be hard to conceive now, in an era of extreme sports and ultra-light equipment, but there was a time when Americans who set out to conquer mountains engaged in a pursuit that was as lonely as it was dangerous.

But four men ? Norm Dyhrenfurth, 94; Jim Whittaker, 84; Tom Hornbein, 82, and Dave Dingman, 76 ? remember. The leather boots that stayed wet for weeks. Oxygen canisters that weighed 15 pounds. The shrugs of indifference most of their countrymen gave a half-century ago to what it would take to get a U.S.-led mountaineering expedition to the top of Mt. Everest.

"Americans, when I first raised it, they said, 'Well, Everest, it's been done. Why do it again?'" Dyhrenfurth recalled Friday as he and three other surviving members of the 1963 expedition gathered in the San Francisco Bay area for a meeting honoring the 50th anniversary of their achievement.

The American Alpine Club is hosting lectures, film screenings, book-signings and a dinner this weekend recognizing the pioneering climbers and what their feat, captured in a Life magazine cover story, came to represent in the years after President John F. Kennedy honored the Everest team with a Rose Garden reception: the birth of mountaineering as a popular sport in the U.S.

"When they were talking about a reunion three years ago, I thought, who the hell cares about that? I figured we'd just together for some beers," Dingman said between interviews with National Geographic, Outside magazine and the Alpine Club's oral history project. "It's turned into this big event, and I'm glad it has."

Whittaker, who lives in Seattle and went on to become chief executive of outdoors outfitter Recreational Equipment Inc., was the first American to summit Everest. He and his Sherpa companion, Nawang Gombu, reached the top of the world on May 1, 1963, a decade after Great Britain's Edmund Hillary and about six weeks after another climber on the U.S. expedition, Jake Breitenbach, died in an avalanche.

Memories of how close he came to his own death on Everest ? he and Gombu ran out of oxygen on the summit and had to climb up and back without water after their bottles froze ? infused every day of his life since with gratitude and child-like wonder, he said.

"I think I will probably take it with me into my next life, if I have one," Whittaker said.

Three weeks after Whittaker's ascent, two other Americans, Hornbein and the late Willi Unsoeld, became the first men ever to scale Everest via a more dangerous route on the mountain's west side. The next day, they descended by the southern route that Hillary, Whittaker and by then, two more members of the American team, had taken to the summit.

The adventure, which included spending the night without sleeping bags or tents at 28,000 feet, made them the first men ever to traverse the world's highest peak ? and cost Unsoeld nine frost-bitten toes.

Dingman has been lauded over the years for sacrificing his own chance to scale Everest to belay Hornbein, Unsoeld and two other climbers, Barry Bishop and Lute Jerstad, who had gotten stuck out in the open with them, back down to base camp.

Dingman never made it back to Everest. As a doctor in training, a Vietnam War draftee and then a physician with a young family, he never could find the time to make the trip. He said he had no regrets then and has none now.

"It would have made no difference to get two more people on to the summit, but if we had lost two or three people on the way down that would have been a very different story," he said.

A look at the deadliest hot air balloon accidents

Tuesday's crash of a hot air balloon near Egypt's ancient city of Luxor, killing 19 tourists, surpasses what ballooning experts believed to have been the deadliest accident in the sport's 200-year history, a 1989 crash in Australia that left 13 dead. Here is a look at some of the worst accidents involving recreational hot air balloons.

? Feb 26, 2013: A hot air balloon flying over Luxor, in southern Egypt, caught fire and plunged 300 meters (1,000 feet) to the ground, crashing into a sugar cane field and killing at least 19 foreign tourists.

? Aug. 23, 2012: Six people died and 26 were injured when a hot air balloon carrying 32 people, mostly tourists including some children, caught fire and crashed near the Slovenian capital of Ljubljana.

? Jan 07, 2012: A hot air balloon struck power lines near Carterton, New Zealand and exploded, crashing to the ground and killing all 11 people on board.

? Oct. 14, 2009: Four Dutch tourists were killed in Guangxi, China, after pilots lost control and their hot air balloon burst into flames and crashed.

? Aug. 26, 2001: Six people including a child were killed when their hot air balloon touched a power line at Verrens-Arvey, in southwestern France.

? June 17, 1999: Four passengers were killed when their hot air balloon hit a power line near Ibbenburen, Germany.

? Jan. 31, 1996: Five people died in the Bernese Alps, Switzerland when their hot air balloon crashed into a mountainside at a height of 2,400 meters (8,000 feet).

? Aug. 8, 1993: Six people were killed when their balloon hit a power line near Aspen, Colorado, tearing off the basket and sending it plunging 30 meters (100 feet) to the ground.

? Dec. 11, 1990: Four people died near downtown Columbus, Ohio, after their hot air balloon hit a television tower and deflated.

? Oct. 6, 1990: Four people were killed in a balloon crash at Gaenserndorf, near Vienna.

? Aug. 13, 1989: Thirteen people were killed when their hot air balloon collided with another over the Australian outback near the town of Alice Springs. The two balloons were flying at an altitude of 600 meters (2,000 feet) when one plunged to the ground after the collision.

? Oct. 3, 1982: An explosion on board a hot air balloon carrying 9 people at a festival in Albuquerque, New Mexico killed four people and injured five.

? Aug. 6, 1981: Five people were killed and one seriously injured when a hot air balloon caught fire after touching electrical wires and crashed in a suburb of Chicago.

? 1785: Two Frenchmen attempting to cross the English Channel in a hot-air balloon were killed when their balloon caught fire and crashed, in possibly the first fatal aviation accident.

The Courier ? Product review: Technic High Lights highlighter

Highlighter appears to be one of the must have beauty products of the moment, helping create a contoured face with defined features. Alison Stainsby has discovered one to rival Benefit?s famous ?high-beam? at a fraction of the cost.

Those of you who, like me, weren?t born blessed with the cheekbones of a supermodel might understand why I have spent an abundance of time (and a little money too) in pursuit of a perfectly angular face. I can?t help but be jealous of British beauties such as Cara Delevigne and Kate Moss (honestly, Google their faces if you don?t know them already, you?ll be green with envy), but I know they probably have a combination of great genetics, and a talented make up team to maximise their assets. Bravely, without either of these, I have embarked upon the same challenge. Through the last couple of years, I have tried using darker shades of foundation to shadow my face, and bronzer to the same effect, but I never considered that the key wasn?t in shadowing, but in highlighting your face. Why not work with what you?ve already got?

It seems to have been only in the last several years that highlighter has come to prominence in the make-up world. Once just the secret of runway make-up artists, it is now available to you in high street shops for (semi) affordable prices. Whilst shopping for a highlighter, I came to realise that it is a fairly expensive commodity ? the cheapest one I could find was going to set me back ?18.50, and that was for Benefit?s notoriously good High Beam complexion enhancer. That was until I was scouring Amazon for bargains, and came across Technic High Lights: an almost identically packaged knock-off highlighter with good reviews, only costing ?3.00. What was there to lose?

It swiftly arrived 3 days later, and I was eager to test it out.

On a fresh face, I did my normal base of primer, concealer and foundation. Then I applied a small amount of highlighter to the tops of my cheekbones, as a series of dots using the nail varnish-style brush. I blended these in with the tips of my fingers, being careful not to veer too far away from the bone. I was left with very softly shimmering and slightly more prominent cheekbones. So obviously, being foolish and excitable, I applied more. This is where I give my first warning about this product: of course, it is meant to be shimmery. But when applied to large areas of the face, you may have the appearance of a 7 year old in glittery face paint. Furthermore, if you?ve got chubby apples of your cheeks, I would avoid blending the highlighter on or close to these.

I then, on the advice of my beauty expert friend, blended it just under the arches of my brows on the brow bone, and a small amount on my cupid?s bow. This had the excellent effect of lifting my brows and opening my face a little, and making my lips look plumper and more lustrous (without expensive and painful collagen fillers).

Overall, when used correctly, this highlighter gives a subtle sheen that really does give your face a touch of model beauty. Obviously I?ve got a way to go before I?m shooting for Yves Saint Laurent?s advertising campaigns, but for a product that cost ?3.00, I?m very satisfied with the results. I don?t feel that there?s a real need to pay another ?15 ? sure, the Benefit High Beam may last longer, but not long enough to warrant its highly inflated price. The Technic version had equal pigment to the Benefit one, and was the same consistency. Overall, I think you can?t go wrong ? save your money by buying a cheap highlighter, and spend it on something that?s really worth spending money on ? good foundation or lipstick, for instance.

Samsung's Galaxy S IV: Everything we know so far

The Galaxy S III is the best-selling Android smartphone ever. So it was awfully big news on Monday when Samsung announced a special press event on March 14 to announce what's probably going to be the Galaxy S IV. Will the new Galaxy tout an even bigger screen? Will nifty new hardware upgrades lead to the iPhone 5's obsolescence? (Kidding.) Here's everything we know about Samsung's next flagship phone:

1. It'll be announced in the U.S. first
Last year, Samsung announced the Galaxy S III in London, but this time, the company's pulling the curtains off in New York City as confirmed at the Mobile World Congress tech show in Barcelona, Spain. Then the company sent this tweet:

Why New York??"We introduced the Galaxy S III in London last year, and this time we changed the venue (to New York) ... as we were bombarded with requests from U.S. mobile carriers to unveil the Galaxy S IV in the country," said J.K. Shin, the head of Samsung Mobile.

2. Its screen probably won't be "unbreakable"
Before the Consumer Electronics Show, a few tech blogs reported that the S IV would be the first handset to use flexible AMOLED screens ? a really tough, malleable material that makes a display virtually?crack-proof. Unfortunately, it looks like that's no longer the case, and the screen will be similar to the ones we're used to. "Flexible screens are still a while off," one source told The Verge.?So what will its next-gen display look like? It's expected to have a higher resolution, at?1080p. And according to some sources, it may even see a slight size bump to 4.99 inches.

3. It might have a swanky new camera
The S IV will reportedly use Samsung's new Orb technology, which allows users to better capture 360-degree snapshots. Essentially, the camera will automatically compress big, landscape photographs for an easier time uploading to sites like Facebook. A few days ago, unnamed users apparently testing the S IV's cameras uploaded some photos to Google+. (The shots have since been deleted.)?EXIF data revealed large pixel resolutions at 4128 x 2322 (9.6 megapixels), which, based on its 16:9 aspect ratio, seems to suggest that the Galaxy S IV will be a 13-megapixel shooter.

4. It'll be pretty fast
Here's a quick rundown of the purported specs, according to a leaked spec sheet:

Trial Against BP To Begin Over 2010 Rig Explosion

Some are calling it "the trial of century." In New Orleans Monday, dozens of lawyers will pack into a federal courtroom to argue over BP's civil liability from the 2010 Gulf of Mexico oil spill. Millions of barrels of oil fouled beaches from Texas to Florida. Billions of dollars are at stake.

It's MORNING EDITION, from NPR News. Good morning. I'm Steve Inskeep.

The worst environmental disaster in American history is the subject of a trial that is beginning today. It's a big and complicated civil lawsuit stemming from the 2010 explosion of the Deepwater Horizon oil rig in the Gulf of Mexico - and, of course, the spill that followed that.

We're going to talk about this with two NPR correspondents who've been covering this story for years. The first is NPR's Debbie Elliott. She's on the Gulf Coast. Debbie, Good morning.

DEBBIE ELLIOTT, BYLINE: Morning, Steve.

INSKEEP: You know, this oil spill - which captivated all of us in 2010 - is starting to feel rather distant in time. Does it feel like a long-ago event, though, on the Gulf of Mexico?

ELLIOTT: Certainly not for the people on the Gulf and who live along the Gulf Coast. You know, a lot of people have seen these ads that BP has been running that say come back to the Gulf. We've cleaned everything up, and everything is great. And the reality is, is that there are still 200 miles of oiled shoreline in Louisiana, for example, wetlands that are still covered in oil. The reality on the Alabama Gulf Coast is that every time there's a thunderstorm or a hurricane or a tropical storm or the surf gets turned up, there are tar mats that are submerged out in the Gulf of Mexico, and that surf churns up those tar mats, and tar balls come back on the beach and have to be cleaned up again. So this is an ongoing event that people have been living with for nearly three years now.

INSKEEP: OK. So this is a story that has faded a little bit from national attention, but is still happening where Debbie Elliott is. And let's bring in now NPR's Carrie Johnson, our justice correspondent. She covers the Justice Department. And let's talk about the case here, Carrie. What does the government have to prove in order to get BP to pay up billions of dollars in damages?

CARRIE JOHNSON, BYLINE: One of the central questions in this trial is whether BP engaged in gross negligence, causing - or helping to cause - an explosion that led to the fouling of the Gulf in April 2010. And BP, as you may remember earlier this year, has admitted to a criminal charge. But BP is still going to argue that it made some mistakes, but the blame should be shared with its contractors, like Halliburton and Transocean, the owner of that Deepwater Water Horizon rig. The Justice Department says it intends to prove that BP acted with recklessness and willful disregard for the safety of workers.

Remember, Steve, 11 people died on that rig. And the Justice Department says through expert witness testimonies, emails from BP officials in which they talk in the days before the spill about flying by the seat of their pants, that they were putting profits over employee safety. That's a huge question worth a huge amount of money, because if the Justice Department can only prove that BP engaged in simple negligence, BP is on the hook for about four-and-a-half billion dollars.

INSKEEP: A lot - but?

JOHNSON: A lot - but almost four times as much if the Justice Department can prove that BP engaged in gross negligence.

INSKEEP: Well, let me just ask: Is it surprising at all to either of you that this has come to trial, rather than BP simply settling out of court, as so often happens with civil lawsuits?

ELLIOTT: You know, I think a lot of observers did expect that this would likely settle, because BP has settled a lot of other cases. They settled with private plaintiffs, the individuals and businesses who were harmed by the oil spill economically and who might have medical claims. BP agreed to pay at least $7.8 billion - could be higher - to cover those claims. BP has admitted its role in the accident and settled criminal charges with the Justice Department.

But last week, we heard BP general counsel Rupert Bondy say the company had been faced with demands that were excessive and not based on reality. And we think that those demands are coming mostly from the states. The two lead states in this litigation, Alabama and Louisiana, have said they are not willing to agree to any settlement unless BP pays enough to cover any long-term damage to the Gulf, damage that we may not know about right now.

INSKEEP: Well, let me ask about that, because when the still happened, it seemed like just an unimaginably bad event. Then there was a round of stories some months later about how maybe the oil spill was not that devastating after all. A lot of the oil seemed to have vanished. Now, Debbie Elliott, you're telling us that years later, oil is still washing ashore. How long is it going to take before we know the true scope of the devastation here?

ELLIOTT: You know, some people will say it could take 10 years, 20 years. Nobody really can answer that question.

JOHNSON: That's right. Many environmental groups and many government scientists are trying to figure that out right now, and it has a huge implication for how much BP must ultimately pay under violations of the Oil Pollution Act.

INSKEEP: Carrie Johnson, thanks very much.

The Pewter Plank recently posted our review of the Tampa Bay Buccaneers contributions from the tight end position in 2012, and we pointed out that there was a?distinct?difference between the tight ends on the roster this past season. Luke Stocker and Nate Byham were both bruising blockers, contributing mostly by paving the way for the running of Doug Martin. Dallas Clark was the primary receiving tight end, failing to contribute to the blocking schemes, and instead adding a moderate amount of production as a pass receiver. With Clark aging and out of contract, it?s obvious that the Buccaneers will need a replacement for him, and it needs to be someone suited to his role in the offense. A tight end with reliable hands who can run good routes and provide a short to intermediate option for Josh Freeman.

That?s where Gavin Escobar is at his best.

The San Diego State prospect is a massive human being, measuring 6 feet, 6 inches tall and weighing 254 pounds. He?s got long arms, big hands, and a solidly built frame, but doesn?t look awkward or uncoordinated considering his size. He?s certainly not the fastest player, even at his position, clocking in at 4.84 seconds in the 40 yard dash at the NFL Draft Scouting Combine. What he lacks in straight line speed, he more than makes up for in agility and change-of-direction, posting solid times in the 3-cone drill and 20-yard-shuttle. This means that Escobar has the natural ability to make cuts while running patterns and beat defenders by breaking hard to the football on timing routes. ?He combines this agility with amazing hands, snatching the ball out of the air with ease with his big hands. He impressed while running ?The Gauntlet? drill at the combine, where he runs in a straight line and receives passes from all directions. He caught every pass in stride and used his hands to secure the ball away from his body and bring the ball in naturally. So Escobar proved at the combine what we already knew about him, he?s a big target that runs good routes and has incredible hands.

Escobar was one of the best tight ends in the nation in 2012, hauling in 42 catches for 543 yards and 6 scores. He was a semifinalist for the Mackey Award (given to the nation?s best tight end), and first-team All-Conference in the Mountain West. He had an even more impressive 2011, including a two score game against Boise State. The decline in productivity is likely due to a drop in quarterback performance, as 2011 signal caller Ryan Lindley moved on to the NFL.

The knock on Escobar, aside from lacking in timed speed, is his inability to be a full-time blocker. Gavin was mainly used as a slot receiver at SDSU, providing a big target for his quarterback, and not often kept in to block for runners. He is somewhat capable of blocking, according to his CBSSports Draft Profile. This concern won?t be as big of an issue for the Buccaneers, who already have solid blocking tight ends. Escobar could play in passing situations more often than not, or line up as a slot receiver with Luke Stocker playing on the line. He could be called upon to block when needed, but he would not need to be a key part of the run blocking efforts for the Buccaneers. The other concern listed on his draft profile is his tendency to get pushed off his route at the line, but that this is something he?s been improving upon. Escobar will likely face tougher competition in the NFL when it comes to getting off the line and getting into his route, so this is something that teams must look at carefully when evaluating Gavin.

Overall, I believe that Escobar would fit perfectly in the offensive role left vacant by Dallas Clark. A taller receiver with soft hands would be a great target for Josh Freeman, who prefers to throw passes higher and allow his receivers to go up and get them. Escobar will be available on the second day of the draft, between rounds two and three, and I think the Buccaneers should definitely target him after?addressing?defensive back and defensive line needs at the 2013 NFL Draft.

College teachers-police clash in Odisha, 50 injured

At least 50 persons including women were injured when private college teachers and security personnel fought a pitched battle in front of the Odisha assembly in Bhubaneswar on Friday, the police said.

The Mahatma Gandhi Marg in Bhubaneswar virtually turned into a battle field after the police used water canon and tear gas shells and finally lathi charged in its bid to restrict the teachers who marched towards the assembly building.

"The police used water canon, tear gas shells to disperse the agitating teachers who broke the barricade. We have chased them away to maintain law and order situation in the area," Deputy Commissioner of Police Nitinjit Singh said.

Singh claimed that some security personnel were also injured in the incident as the teachers pelted stones on them.

The police have taken about 200 people into custody and allegedly demolished the temporary camp of the agitating teachers at one end of Mahatma Gandhi Marg in Bhubaneswar.

Rapper, cabbie meet violent end together in Vegas

LAS VEGAS (AP) ? Kenny Cherry was an aspiring rapper who moved from the Bay Area to Las Vegas to pursue his career. His music videos online show him cruising the Strip in his Maserati.

Michael Boldon was a family man and taxi driver who hailed from Michigan and loved fast cars.

The two men's lives ? along with that of an unidentified passenger in Boldon's cab ? ended in violence normally seen only in movies: gunfire, a fiery crash and an explosion before dawn Thursday on the neon-lit Las Vegas Strip.

As investigators Friday tried to find the gunman in a black Range Rover SUV who triggered the shocking chain of events, families and friends tried to grasp the blink-of-an-eye finality of it all.

"Right now my heart is breaking," said Cherry's great aunt, Patricia Sims, of Oakland, Calif. "This has really been a tragedy. Kenny was just a delightful kid."

Sims, 75, said Cherry moved to Las Vegas from Northern California, though she didn't know her nephew was a rapper using the name Kenny Clutch.

Cherry's parents were traveling to Las Vegas on Friday to claim his body. The 27-year-old, whose full name is Kenneth Wayne Cherry Jr., was driving a Maserati that was peppered by gunfire before it sped through a red light and smashed into Boldon's taxi.

The taxi exploded into flames, killing Boldon and female passenger Sandra Sutton-Wasmund, as four other vehicles crashed like pinballs at an intersection overlooked by some of Las Vegas' most famous hotel-casinos: Bellagio, Caesars Palace, Bally's and the Flamingo.

Police think an argument at the valet area of the upscale Aria resort-casino led to the shooting, but they haven't shared details. The shooting happened the same night that Morocco-born rapper French Montana was playing at Aria's signature nightclub, Haze.

"What the original disagreement was is crucial to the ongoing investigation and the identification of the suspects," said Las Vegas police officer Bill Cassell.

He said investigators were examining surveillance video and enlisting help from federal authorities and agencies in neighboring states to look for the distinctive Range Rover. It had blackout windows and custom black rims and was last seen speeding away from the fiery scene around 4:30 a.m. Thursday.

Police said a passenger in the Maserati was wounded in the arm but was treated at a hospital and released. He was reported to be cooperating with investigators, and his name wasn't made public.

Cherry's father, Kenneth Cherry Sr., of Emeryville, Calif., said he was struggling to handle his grief.

He said his son started a music career in Oakland after attending two Catholic high schools. According to his father, Cherry was recognized by other rappers within a West Coast hip-hop strain called hyphy.

Cherry was not well-known in wider music circles, according to Chuck Creekmur, CEO of AllHipHop.com.

"I had never heard his name before," Creekmur said.

Kenny Clutch's YouTube music video, "Stay Schemin," shows scenes of hotels along the Strip as he sings about paying $120,000 for his Maserati.

"One mistake change lives all in one night," he raps in one verse.

Cherry Sr. said he didn't know how his son made money or if he had any other jobs.

"I want to make it clear that my son was no gangster or nothing like that," he told The Associated Press. "He moved to Vegas about six year ago and he was writing music and rap."

Court records show Cherry had no criminal cases or convictions in Las Vegas, and Cassell said there was no record of arrests.

The police spokesman wouldn't say whether investigators determined if Cherry owned, rented or borrowed the Maserati. Cassell called that information "integral to the investigation."

Meanwhile, Boldon's family struggled to cope with his death.

"It's very devastating for us, for my family," said Tehran Boldon, 50, younger brother of the 62-year-old taxi driver. "Our family has no history of violence or gang membership that would predict losing a family member to such an event."

Boldon's sister, Carolyn Jean Trimble, said Boldon was a father, a grandfather and a car enthusiast. He was one of five children born and raised in Michigan, where he took care of his ailing father, who fought cancer, before moving to Las Vegas to be with his 93-year-old mother.

Bolden had owned a clothing store in Detroit and worked at a car dealership, his sister said. He began driving taxis after moving to Las Vegas about 1 1/2 years ago.

Boldon loved watching IndyCar and NASCAR races and drove a Mercedes when he wasn't in a cab. An avid car enthusiast, he tried to persuade Trimble to buy a Bentley, she said.

"Everybody just loved him," the older sister said. "When that car hit that cab, Mike had to be in there talking and laughing."

The irony that a man with a taste for beautiful cars was killed by a sports car wasn't lost on Trimble.

"He would be tickled to death: 'Damn, of all things, a Maserati hit me, took me out like that,'" she said. "I'm happy he didn't suffer."

The county medical examiner said both Boldon and his passenger, Sutton-Wasmund, died of blunt force injuries and that their deaths were being treated as homicides. The 48-year-old woman was from Maple Valley, Wash.

Besides Cherry's passenger, police said five people were treated for injuries after the six-vehicle crash. No one was said to face life-threatening injuries.

Jogger Eric Lackey snapped a cellphone photo of the blazing scene moments after the crash. Black smoke billowed from the flaming taxi, amid popping sounds from the fire.

The famously glowing, always-open Las Vegas Strip was closed for some 15 hours before reopening Thursday night. One Nevada Highway Patrol sergeant recalled a similarly long closure after the 1996 drive-by slaying of rapper Tupac Shakur.

That shooting ? involving assailants opening fire on Shakur's luxury sedan from a vehicle on Flamingo Road ? happened about a block away from Thursday's crash.

The Shakur killing has never been solved.

Why the less expensive iPhone might make more sense

If Apple sticks to their current pattern, there'll be an iPhone 5S later this year, and the iPhone 5 will drop to $100 on-contract, the iPhone 4S will drop to free on-contract, and the iPhone 4 will be retired. If Apple sticks to their current pattern, there'll be an iPhone 6 in 2014, and the iPhone 5S will drop to $100 on-contract, the iPhone 5 will drop to free on-contract, and the iPhone 4S will be retired.

Rumor has it Apple has explored the idea of less expensive iPhones for years, but ultimately decided to drop the price of previous generation iPhones instead. It allowed them to eventually get to zero dollars on-contract, it let them exploit economies of scale, but it didn't service the needs of emerging markets where phones aren't typically sold on-contract, and even the zero dollar option costs $450. It also relied on newer models being sufficiently distinct in hardware to justify their higher price points. The iPhone 4 has Retina and a new, glass and metal casing. The iPhone 4S was more of a challenge, with little visual distinction, and marketing focused a little on speed and camera, and a lot on Siri. The iPhone 5 had a bigger, 4-inch, 16:9 screen, and LTE.

Even with speed and size as obvious distinctions, the iPhone 5 still faced stiff competition from... the iPhone 4S and iPhone 4. For many people, that design, that screen size, that radio technology is good enough. And at those lower price points, it's great.

Apple CEO Tim Cook, during the Q1 2013 conference call, said the iPhone 4 and iPhone 4S haven't yet cannibalized iPhone 5 sales. More specifically, he said the product mix this year, with the iPhone 5 as the flagship, was essentially the same as last year, when the iPhone 4S was the flagship. That -- maintaining the average selling price for the iPhone -- is important for Apple's inventors who value the bottom line. But what happens later this year, or next? What happens when the 4-inch LTE iPhone 5 is $100? When it's $0?

Arnold Kim of MacRumors and I discussed this on last week's episode of the iMore show. It's not impossible to imagine a world where the flagship iPhone, be it iPhone 5S or iPhone 6, is the flagship iPhone, and the less expensive iPhones aren't just older models sold at incremental $100 discounts, but iPhones specifically designed to be less expensive.

Again, less expensive doesn't mean cheap, Apple doesn't do cheap. They don't do crappy netbooks or budget tablets. They do the Mac mini and the iPad mini, the iPod nano and the iPod shuffle.

Whether they return to plastic backs offered in their reserved-for-lower-end color palettes, and keep less expensive, less expansive, components inside like chipsets, radios, and cameras, or once again zag instead of zig, as much as a less expensive iPhone could increase Apple's addressable customer base in emerging markets on carriers like China Mobile, it could also decrease the pressure on Apple's premium phone business in established markets on carriers like AT&T and Verizon.

If Apple sticks to their current pattern, at some point this year you'll be able to walk into a store and choose between an iPhone 5S for $199+, an almost indistinguishable looking iPhone 5 for $99, and a decent iPhone 4S (iPhone mini) for $0. If Apple sticks to their current pattern, at some point next year you'll be able to walk into a store and choose between an iPhone 6 for $199+, a presumably different looking iPhone 5S for $99, and an almost indistinguishable looking iPhone 5 for $0.

But Apple doesn't always stick to their current patterns. And if they don't, maybe at some point in the future you'll be able to walk into a store and choose between the flagship iPhone 5S or iPhone 6 at $199+ on-contract, or a distinctly different iPhone that's less expensive both on-contract and off.
